Another successful eviction

A 37-year-old woman has been evicted from her council house after she flouted the terms of a Court Order.

In December 2005 the Council provided the County Court with evidence that the property had been allowed to be used for the taking and selling of drugs and an order was issued.

The activities taking place at the South Square house brought about anti-social behaviour in the surrounding area from the constant stream of visitors to the property. There were reports of fighting and visitors hanging around on the street corner and discarded used syringes littering the area.

Cllr Sue Wright, Cabinet Member for Adults, Community Safety and Health, said: “This is another successful eviction that will improve the lives of residents in the area. Anti-social behaviour is not acceptable in Blackpool and we want to make sure residents know they can come and talk to us and we and will help.

Although the majority of council tenants abide by their tenancy agreement this case shows we will take strong action against those who continue to break the terms of the agreement and disturb their neighbours.”

Two drug warrants were executed at the property in 2005. The first raid uncovered a quantity of Class A and Class C drugs. The second raid found evidence of drug taking paraphernalia.

The Court Order prohibited the tenant from allowing named individuals to visit the address or be convicted of an arrestable offence in the locality or within the property. The Order also dictated that the woman had to abide by all tenancy conditions.

On one occasion when the order was breached by the tenant the Police found the electricity meter had been wired to allow the use of free electricity and individuals named on the County Court Order were also found to be present in the property.

Under the terms contained in the tenancy agreement a tenant is responsible for the actions of visitors to the property even whilst entering or leaving the property.
